Terms of Service

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

PlacePixie helps you decide where to eat by learning your dining preferences (a "taste profile") and recommending a single restaurant suited to your query, along with an explanation of why it was chosen. Recommendations are generated using your taste profile, stated preferences, and, where available, factual information about venues. Recommendations are suggestions only — we do not guarantee that any recommended venue will be open, available, or suitable for your needs at any given time, and you should independently verify details (hours, availability, pricing, allergen handling, etc.) directly with the venue before relying on a recommendation.

We do not accept payment from venues to influence, alter, or unlock recommendations.

You may create an account using email/password, phone number, Google Sign-In, or Apple Sign-In. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate information and keep it up to date. You may not share your account with others or use another person’s account without permission. We may suspend or terminate your account if we reasonably believe you have violated these Terms.

You control the taste, dietary, and location preferences you provide, and any feedback or ratings you submit. By submitting this information, you grant us a license to use it to operate and improve the Service, including generating and refining your recommendations, as described in our Privacy Policy.

You agree not to submit false, misleading, abusive, or unlawful content or preferences, and not to attempt to manipulate, abuse, or interfere with the recommendation system.

If you enable location-based ("Nearby") suggestions, you consent to us collecting your device location for that purpose, as described in our Privacy Policy. You may disable this at any time; some features may be unavailable if you do.

You agree not to: use the Service for any unlawful purpose or in violation of these Terms; attempt to gain unauthorized access to the Service, other accounts, or our systems; reverse-engineer, scrape, or extract data from the Service except as permitted by applicable law; interfere with or disrupt the integrity or performance of the Service; impersonate any person or entity, or misrepresent your affiliation with any person or entity; or use automated means (bots, scripts) to access the Service without our prior written consent.

We reserve the right to suspend or terminate access for violations of this section.

If you sign in using Google or Apple, your use of those services is also governed by their respective terms and privacy policies. We are not responsible for the practices of those third parties.

The Service, including its design, features, and underlying technology (but excluding your own content and preferences), is owned by PlacePixie or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms.

THE SERVICE AND ANY RECOMMENDATIONS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT RECOMMENDATIONS WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR PARTICULAR DIETARY NEEDS, ALLERGIES, OR OTHER REQUIREMENTS. YOU ARE SOLELY RESPONSIBLE FOR VERIFYING VENUE INFORMATION, INCLUDING ALLERGEN AND DIETARY SUITABILITY, BEFORE VISITING OR ORDERING.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLACEPIXIE AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING RELIANCE ON ANY RECOMMENDATION, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $50.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

You agree to indemnify and hold harmless PlacePixie and its officers, employees, and affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your violation of these Terms or misuse of the Service.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Sections of these Terms that by their nature should survive termination (including Sections 8–11 and 13) will survive.

These Terms are governed by the laws of the State of [INSERT US STATE], without regard to conflict-of-law principles, and any disputes will be subject to the exclusive jurisdiction of the courts located in [INSERT US STATE/COUNTY].
